Credit Card Terms and Conditions

The following terms and conditions apply to Socket Mobile’s Advanced Replacement Service (“Advanced Replacement Service”) provided in conjunction with any services offered under Socket Mobile Limited Warranty and any of the Socket Mobile Extended Warranty plans.  This service is additional to the options available at no charge under Socket Mobile, Inc’s Standard Warranty and does not otherwise affect your statutory rights.

i. Advance Replacement Service can minimize the amount of time you are without your Socket Mobile, Inc (“Socket Mobile”) product.If you choose to use this Service, Socket Mobile will send you a Replacement Product to replace your original product that has become defective (“Original Product”).

ii. If your Original Product is still covered under a Socket Mobile plan namely Standard Limited Warranty, Standard Extended Warranty, Extended Warranty with One Time Accidental or Premium Extended Warranty, and you return your Original Product such that Socket Mobile receives it within thirty (30) days from the date Socket Mobile ships the Replacement Product (the “Return Period”) you will only have to pay the Advanced Replacement Shipping Charge. IF SOCKET MOBILE DETERMINES THAT YOUR ORIGINAL PRODUCT IS NOT COVERED BY A SOCKET MOBILE WARRANTY OR IF THE PRODUCT IS NOT SHIPPED WITHIN THE RETURN PERIOD, then YOU WILL BE CHARGED Socket Mobile’s Retail Price of the Replacement Product. All charges referred to herein shall include all applicable taxes.

iii. If your Socket Mobile Original Product becomes defective within the first 30 days of ownership Socket Mobile will replace the defective Original Product with a brand-new Replacement Product with a minimum of 12 months manufacturer’s warranty.

iv. If your Socket Mobile Original Product becomes defective after 30 days of ownership, but before the expiration date of the Socket Mobile Limited or Extended Warranty for the Original Product, Socket Mobile will replace the Original Product with a manufacturer’s refurbished Replacement Product with either a 90 days manufacturer’s warranty or with the remaining portion of the warranty from the Original Product plus 90 days, provided the serial number of the Replacement Product is provided to Socket Mobile when the Replacement Product is received by the end user.

v. When you order Advanced Replacement Service, you will provide to Socket Mobile your credit card details. Socket Mobile will ship the Replacement Product to your designated location and will charge your credit card the Advanced Replacement Shipping Charge displayed at the time of selecting available shipping options and the Service Charge, if applicable, at the time the Replacement Product ships.

vi. You must return your Original Product such that Socket Mobile receives it within the Return Period. You must also return the Original Product in the package that contained the Replacement Product in accordance with Socket Mobile instructions. Socket Mobile will retain the Original Product and you will retain the Replacement Product.

vii. If your Original Product is warranted under the Extended Warranty with One Time Accidental Warranty plan and not under any other Socket Warranty Plan, under this Advanced Replacement Service, at the time of the shipping of the Replacement Product, your credit card will also be charged the applicable Service Fee as outlined here. Should your Original Product be found to be defective due to Manufacturers failure rather than due to Accidental Damage, the Service Charge will be refunded to your credit card.

viii. In addition, at the time the Replacement Product ships, Socket Mobile will affect DEPOSIT against your credit card equal to the Socket Mobile retail price, excluding taxes, of a new Product (“Replacement Value”).Current Product prices can be viewed at www.socketmobile.com. This DEPOSIT will be maintained by Socket Mobile. Socket Mobile will apply against your credit card for (i) the Replacement Value if your Original Product is not eligible for Product Replacement under this Advanced Replacement Service; and (ii) the value of any charges that you owe Socket Mobile under this Advanced Replacement Service. Conditions for ineligibility for this Service include, without limitation:

(a) Any damage to the Original Product that is not covered by a Socket Mobile warranty. Some of the conditions that Socket Mobile warranty does not cover:

  • Expiration of the term of the warranty;
  • The Product has been modified or repaired by non-authorized personel;
  • The Product was used outside the published specifications (e.g water damage on SocketScan Series);

(b) Loss of the Original Product; and

(c) Socket Mobile does not receive the original product within the Return Period.

ix. If Socket Mobile determines that your Original Product is eligible for a free Replacement Product under the Advance Replacement Service, your credit card DEPOSIT will expire, and you will owe Socket Mobile no other fees or charges under the Advance Replacement Service. In addition, after confirmation that all charges owed to Socket Mobile have been paid, the DEPOSIT on your credit card will also expire.

x. Socket Mobile will refund any DEPOSIT if the defective scanner is deemed to be ELIGIBLE FOR REPLACEMENT and is returned within 30 days of the Replacement Product being dispatched.

xi. Socket Mobile will start the DEPOSIT refund process the Friday following receipt and acceptance of a defective scanner that is deemed to be ELIGIBLE for replacement.

xii. Socket Mobile is not responsible for the time it takes any associated Merchant to process the refund and apply it to a customer’s credit or debit card.

xiii. In the event of any dispute regarding any of the previously mentioned points the decision of Socket Mobile will be final and cannot be appealed.

Note: Country variations

The contractual rights with respect to returns, refunds and warranties you are entitled to under these terms are in addition to the statutory rights you may be entitled by the laws and statutes in your country, state or locality.  For example, in Australia, these rights are also governed by the Competition and Consumer Act 2010 and other applicable Australian consumer protection laws and regulations. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Under the Australian law, you may be entitled to a repair, replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You may also be entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Confidentiality and Privacy. Information that you transmit or post to our website will be considered by us to be non-confidential and non-proprietary and, except for Personally Identifiable Information, may be used by us for any commercial or noncommercial purpose. Personal Identifiable Information is personal information about you, including your name and address, social security number, credit card numbers or other information from which you can be personally identified. We will not sell, rent, or lease your Personally Identifiable Information. We will not disclose your Personally Identifiable Information to others except to the Socket Mobile employees and/or business partners who are acting on our behalf for the uses described on the Site where the information has been requested.

Inappropriate Material. Our Website is not intended to contain any information that is confidential, infringes the intellectual property rights of others, or is obscene, pornographic, libelous, defamatory, threatening or otherwise unlawful. In no case shall Socket Mobile, Inc., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Socket Mobile, Inc. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20 - VAT (EU Store)

Both, inc and ex VAT prices are shown on this website. Please note that the inc VAT price (including 19% German tax rate) is applicable where the customer placing the order is established in Germany, or they are established in another EU Member State and are not registered for VAT.

For customers established in other EU Member States and, who can provide a valid VAT registration number, the price will be adjusted to treat the sale as exclusive of VAT. These customers will be required to provide confirmation that they are officially registered for VAT; this can be best evidenced through the provision of a valid VAT identification number when creating your customer account.

In instances where the customer is not established in Germany and with evidence of a valid VAT number then we will confirm upon receipt of your order the VAT exclusive price to be paid; payment will only be taken after this price has been confirmed. Where a valid VAT identification number is not provided, we will be required to account for German VAT on the transaction.

 

 

Socket Mobile Privacy Policy

Socket Mobile respects your privacy and is committed to its protection. We’ve structured our website so that you can visit the Socket Mobile website www.socketmobile.com and our affiliated web-based Socket Stores without identifying yourself or revealing any personal information. Personal Information is any information related to a natural person that can be used to directly or indirectly identify the person.  Such information includes a name, a photo, an email address, a personal address, bank or credit card details, or online identifiers such as a cookie ID or an IP address.  We only request the minimum personal information needed to support your relationship with us and we only accept and use that information with your express permission. We do not sell, rent, or lease your personal information to others.  We do not provide your personal information to others except to selected third-party processors who assist us in fulfilling your requests, such as shipping of product or processing of payment, and who are committed to protecting your personal information. Upon your request, by filling out our Personal Information Request Form, we will provide you with a copy of your personal data in electronic format at no charge and/or will anonymize any personal information you’ve provided to us (right to be forgotten) but will retain non-personal information. We may delay anonymization of personal information while a related transaction you authorized with the personal information is pending.

Examples of personal information we collect are as follows: 

  • When you order products from our web stores, we request your shipping information so we know where to ship the products and we request credit card or PayPal information for you to pay for the products you’ve ordered.
  • When you return products to us for replacement or repair, we request shipping information so we know where to return the replaced or repaired products and we request credit card information for you to pay for the replacement or repair if not covered under warranty.
  • When you sign up for newsletters or other information that we distribute by email, we request contact information including name, address or email address, so we know where to send the requested information.
  • When you register as a developer to use our software developer kit with your software applications, we request contact information including name, address, email address and phone number so we know where to send the requested and future developer related information. We request credit card or other financial information to enable you to pay a small initial administrative fee. We may also ask for additional information about your areas of interest as a developer including the markets you are addressing with your applications to enable us to be responsive to your needs as a developer.
  • When you receive products from us as a customer, you are directed to a Companion Application downloaded from your platform App store to assist in starting up and using the product.  The Companion Application also requests you provide information on where you purchased the product and the application used with the product. We retrieve the Bluetooth MAC address from the product to validate the product warranty.
  • We may collect personal information at trade shows for follow up after completion of the show.
  • We maintain contact information from our vendors who supply us with inventory components or services.
  • We obtain names and addresses of non-objecting shareholders from time to time to assist us in identifying and communicating with our shareholders.

Use of Cookies to collect website usage data.  We place cookies on selected website pages to help us analyze website usage.  We do not use cookies to collect personal information.

Personal information about children under the age of 16 requires parental consent. We do not knowingly collect information from children under the age of 16 and we do not target our website to children under 16.

Third party processors are engaged by us for processing certain transactions such as fulfilling your orders for products that are ordered through our web stores or processing your credit card if a payment for product purchases or services is required. We transfer personal information to third party processors sufficient to carry out the service provided by the processor such as fulfillment of your order. We confirm with each third-party processor that they maintain confidentiality of your personal information and provide at least the same level of protection of your personal information as we do.

Legal Basis for Processing Personal Information.  We only process personal information when we have obtained clear affirmative consent from the person to use the personal information to accomplish a stated purpose such as supplying a product or providing a service that requires the use of personal information, or to fulfill a contractual obligation.  In each case, we request consent to be freely given, to be specific to accomplishing a specified task, to be informed by describing the limited use of the personal information, and to be unambiguous as relating to a specific task.

Breach of Personal Information.  We protect our systems and data from unauthorized access, accidental or unlawful processing,  loss, destruction, damage, theft, alteration or disclosure of personal information through a combination of firewalls, security monitoring systems, data encryption and access controls.  Should we become aware of an unauthorized breach of personal information, we shall identify the affected data records and notify the affected personnel within 72 hours of detection.  Our third-party processors are required to notify us in the event they detect unauthorized access to your personal information.
